강연 초록:
The Emotions of Justice is a study on the nature and modes of justice in early modern Korea. Focusing on the petitioning activity of various subjects during the Chosŏn dynasty (1392–1910), it concentrates on three discursive fields of law: the role of emotions in administering justice; the construction of legal culture through the performative aspect of petitioning; and the formation of multilayered legal subjectivities. By tracing a discourse of emotions and linguistic practices in the juridical field of the Chosŏn, this book presents a new conceptualization of non-Western and early modern justice by drawing on a wide range of previously unexploited sources, including literary Chinese and vernacular Korean petitions, official documents, criminal records, legal codes, and didactic texts. The book pushes the theoretical, methodological, and empirical boundaries of our understanding of justice in early modern and non-Western societies. By examining the intersection of gender, status, emotions, and law, it aims to further the interdisciplinary dialogue beyond East Asian studies and expand the historical scholarship on the topic of justice.

미국 조지워싱턴대학교 사학과의 김지수 교수는 한국 근대 시기 젠더사 및 법사 전공자이다. 범죄와 정의, 법의학, 감정사, 문헌 속 법의 재현, 양층언어, 토착어, 젠더와 섹슈얼리티 등의 주제에 관심을 기울여 왔다. 제임스 팔레 한국학 도서상을 수상한 김지수 교수의 저서 <정의의 감정: 조선시대의 젠더, 신분 그리고 법률 관행 The Emotions of Justice: Gender, Status, and Legal Performance in Chosŏn Korea >은 법의 영역에 나타난 감정의 담론을 통해 원(冤)에 관한 내러티브가 정의를 추구하고 수행하는 데 중대한 역할을 했다는 점에 주목하였다. 김지수 교수는 현재 그녀의 두 번째 저서 <Crime of Violence: Forensic Medicine, Dead Bodies, and Legal Culture in Early Modern Korea(가제)>를 저술하고 있다.
